Terms & Conditions | Amazing Designs Agency (Pty) Ltd

1. Introduction & Binding Agreement

These Terms & Conditions govern all quotations, website design and development builds, branding packages, UI/UX prototypes, digital marketing campaigns, and print production services provided by Amazing Designs Agency (Pty) Ltd ("the Agency"), situated at R10 Mjojeni Road, Umlazi, Durban, 4066, KwaZulu-Natal, South Africa (084 423 1906 / 031 907 0071 / info@amazingdesignsagency.co.za). By accepting a written quotation or paying a project deposit, the Client agrees to these terms in accordance with the Electronic Communications and Transactions Act (ECTA), Act 25 of 2002, and the Consumer Protection Act (CPA), Act 68 of 2008.

2. Quotations, ZAR Pricing & Payment Milestones

• All prices quoted on our 2026 South African Price List or in formal written estimates are denominated in South African Rand (ZAR) and remain valid for 30 calendar days from the date of issue.
• Unless otherwise agreed in writing, projects require a 50% commencement deposit before design concepts or development staging begins, with the remaining 50% balance payable upon project approval prior to final master file handover, live website deployment, or commercial print dispatch.
• Additional features, extra pages, or scope additions requested outside the original written quotation will be quoted separately for Client approval before execution.

3. Project Timelines, Revisions & Client Content

• Initial branding concepts or website staging previews are typically presented within 48 to 72 working hours (or 5–10 working days for complete multi-page websites) once the deposit and client brief/assets are received.
• Every package includes structured revision rounds during the concept and staging phases. Revisions requested after final sign-off and file handover are billed at our standard studio hourly rate.
• The Client warrants that any logos, text, trademarks, or photography supplied to the Agency are owned or properly licensed by the Client.

4. Intellectual Property & 100% File Ownership

Upon receipt of full and final payment in ZAR, 100% copyright and ownership of the approved final deliverables - including vector master files (AI, EPS, SVG, CMYK PDF) and custom website HTML/CSS/JS/PHP source code - transfers in full to the Client. Preliminary rejected drafts or unused concept explorations remain the property of Amazing Designs Agency (Pty) Ltd.

5. Website Hosting, Maintenance & Third-Party Gateways

Clients are never locked into mandatory hosting contracts; we can deploy your completed website to your own hosting provider or provide optional South African NVMe SSD hosting and monthly security maintenance from R250–R650/month. Where third-party payment gateways (such as PayFast, Ozow, Yoco, or Peach Payments) or domain registrars are integrated, the Client remains subject to those providers' respective merchant terms and transaction fees.

6. Print Proofs, Colour Variations & Nationwide Courier

For commercial print orders (brochures, flyers, corporate stationery, and signage), the Client must sign off on the final digital proof before lithography or digital press production begins. Minor CMYK press tolerances compared to RGB backlit screens are normal industry standards. Nationwide courier delivery is available across all 9 South African provinces.

7. Cancellations, Limitation of Liability & Governing Law

If a project is cancelled by the Client after creative or engineering work has commenced, the commencement deposit covers the studio time and concepts already completed up to the date of written cancellation. Amazing Designs Agency's maximum liability under any engagement shall not exceed the total fee paid by the Client for the specific service in question.
